Eagle has two matters (very silk on cross and up of the inisgnia)

Agree. I wouldn't have a problem with a lower rank officer but this is unrealistic.

There is no way he wasn't already an officer in 1935 when the piece is dated. Meaning it wouldn't have been issued to him ever.
