This patch is ebroidered variant of the Bevo made Indian Legion insignia. That is only a third time I have seen such variant. Those who collect volunteer insignia tend to believe them to be original. I never held one in my hands and cannot comment, but most likely this is a good one. I would also do a Black light and Burn tests just to make sure.

I disagree with Lloyd’s opinion that “this patch looks like a WW2 type us army patch same sort of embroidery”. A typical WW2 us army patch embroidery is noticeably different as shown in the example below:
