Manly forget anything from Latvia I have been burnt a few times and these guys really know what they are doing! Ty if I was you yes put in a PayPal dispute as soon as possible as these crooks are protected as I have found in the past, as I have even tried to put in a fraud complaint to the Latvia Police and that was a waist of time and money

Paypal dispute

I agree that based on the photos it is clearly a fake helmet. However, I think you would greatly increase your chances of trouble with the seller if you open a Paypal dispute before even receiving the item. There is a flip side version to Paypal fraud as well.

That is a buyer using the dispute/charge back to actually steal an item from a buyer by paying for an item then having Paypal take the money back based on a lie about never recieving said item. He can claim that this is your real motive.

I don't think you have a real dispute (in the eyes of Paypal) until the seller fails to honor the 7 day return period. I strongly recommend that you turn this helmet around the same day you get in in the mail if at all possible. Make certain you can track the package and confirm delivery as well. This will limit the seller's wiggle room to claim he meant 7-days from the day HE sent it to you. You need to have it back in his hands as soon as possible.

Finally, if this does go to Paypal dispute please keep us posted as to the progress and process. I would be curious to see how their willingness to help resolve this issue is influenced by the fact that you used their service to pay for something that they really do not want their service used for. We all need to be careful how we use PP in this regard.

EXCELLENT! I fully endorse these comments. Get yourself a tracking number, as far as PayPal goes make sure you cover all your bases as PayPal ALWAYS take the buyers side so beware sellers.

Totally bad helmet, but very good advice regarding Paypal and disputes. You will not be able to recover the shipping costs.

I recently had a item i wanted to return because it was fake. the ebay seller didnt want to know, and paypal were not very helpful. Even after the person the seller sent me to to prove authenticity said it was fake.

But as soon as i mentioned on the phone i had an ebay buisness account, paypal couldnt do enough to help me.

As long as the seller can prove that he sent you the helmet Pay Pal cannot enforce a refund based on accuracy of description unless it's an eBay purchase.

I learned this from the sellers perspective. A Belgian purchaser received my items, made up some bogus story about it and wanted a partial refund. Pay Pal froze my account, I proved that I had sent it and they closed the case in my favour.

DO NOT open a claim until you have absolutely no options left.

Hopefully my comments regarding the use of PP are fully understood...

What I am saying is that should PP learn the dispute is from a buyer who used PP to pay for a Waffen SS Helmet, their sympathy meter might just register zero To the exact "letter of the law", this purchase was a violation of their terms of acceptable use from their point of view. Therefore, they just might see their obligation as nullified


The odds of such might be low, but this is not just a negative presumption on my part. Go read how they handled Bill Shea's use of PP services on his website and PP's view of their own terms of use should be quite clear. He has a nice little rant about it in the Ruptured Duck "Tidbits" section.

I would try thing else before asking PP to help. If one must, I would try to not fully disclose the nature of the item paid for if possible
