    Help, Want to sell rifle. Gun show? USPS?

    Hi All:
    Contemplating selling my early '40's M1 Garrand.
    Thing is... I bought it at local gun show. So consequently it is
    registered in my name.
    If I sell it person to person at the show, would I need the new owner
    to sign some kinda personal statement so I can prove it's not
    mine anymore? In case it is later linked to some kinda crime?
    And...
    If I sell or buy online what is the procedure for my local gun man to
    send or receive to another gun man?

    If you live in Texas, it is not registered in your name. The dealer may have required you to fill out a Form 4473, but that is not a registration form. The seller calls in the information you have put on the 4473, and a quick check is done to see if you have any type of record that would prevent you from owning the rifle. No information is suppose to be retained from the insta-check, but the seller does keep the 4473 in his records.

    If you sell it at a gun show you might want to get the buyers name and drivers license number for your records.

    If you sell online you can ship to a C&R License holder or dealer as long as no restrictions are in the buyer's state. You can ship a long gun through USPS which I find easier than UPS or FedEx.

    If you buy on line, your purchase will have to come to a firearms dealer. He may require additional information from the seller.

    An early 1940 rifle would probably have been a gas trap. I assume it is a rebuild converted to gas port?

      be sure buyer is not a convicted felon

      you may wish to use a bill of sale that includes a question that asks that the buyer disclose if he is a convicted felon. i know here in fla thats a big deal and i can't imagine it not being so in texas to.

        Thanks guys. I'm gonna go see the gun dealer now about prices.
        I should say mid '40's.
        An M1 Garrand. A nice shooter in incredibly clean shape.
        Will list it here more than likely.

          The only obligation in a private gun sale in Texas is to reasonably assume that the buyer is a resident of Texas and can legally own a firearm. If the buyer produces a valid Texas drivers license it is reasonable to assume they are a resident. Most people won't give an individual their drivers license information. A bill of sale shows you made a good faith effort to determine the buyer complied, but is not required.
