I don't see any police markings on this holster? It looks like a commercial holster to me.

It never made it from the factory to the police, to get police markings. But the fixing of the closing-strap is typical for police.

I have seen a lot of examples of that general type of holster (with the upward closure) that is not police. We see that very often in P.38 holsters, an upward closure but accepted by the Heer. The belt loop is very narrow on that holster compared to what I am familiar with. Also, the toe is a bit of an odd shape.
