I have a P38 I bought in a gun store years ago. How would I go about selling it leagally on e-stand?

Post it with clear pictures, state a price, payment and shipping conditions. Be sure to collect a valid signed 01 /03 FFL and check with authorities in your locality for any conditions on legal transfers. Good luck.

I apologise for my ignorance but what do you mean by "collect a valid signed FFL". Do you mean get one from buyer in mail?

Whoever purchases your pistol must send a signed copy of their FFL or C&R 03 license. You can then send it to them at the address on the lic. via us post (about $12 flat rate) insurance will add to the cost. Keep the copy of their license for your records to show who you sold the pistol to. It is best to get a postal money order or bank check for payment. What is it you will be selling? I would be interested in a p38 or any other german pistol you are getting rid of. hope this helps frank v.

You need to know the local laws where the pistol would be shipped. In California, it is illegal to ship a handgun to a C&R license holder unless they have a special certification (I think it is called a Certificate of Eligibility).

When you ship to a FFL they must take the responsibility to know what is legal in their area. Be sure you ship it legally on your end. If you are a FFL01 you can use the USPS, if not than it will have to go UPS-FedEX next day air.

Jerry I think you have it backwards. When you are sending to or getting a firearm from an 01 FFL you must us ups overnight. The reason is due to the address on the package that could identify it as being a firearm. Say it is addressed to "JOES GUN SHOP" They do not want that package sitting around a postoffice or other places enroute. To much chance of theft. When I send a firearm to an individual with a C&R or get one sent to me on my C&R we always use the postal service. This was cconfirmed to me by the ATF at my most recent compliance check. frank v.

It's my understanding that the USPS requies both parties to have a license when shipping a handgun. UPS only requires the receiving party to have a license.

The USPS regs say both parties must be "dealers" but I understand the interpretation of that is "license holders".

As far as the ATF is concerned, only the receiving party must have a license.

Yes Leon I believe you are right but That type of regulation is not what I was refering to. I was talikng about Jerry's statement that a C&R lic holder had to ship with ups overnight and an 01 FFL could us the post office. I am sure it is the other way around, that an 01 ffl must use UPS and a C&R can use the post office.

No I stand by my words. The ATF has nothing to do with this. You have to send firearms to an FFL, except if it is being returned, but the way you send them are dictated by the carrier. The USPS requires that both parties be dealers, UPS-FedEX require over night because they do not want them in the system. They have a problem with thieves that they hire. USPS is cheaper but as a FFL03 I can not use them.
