    Question about selling a deact weapon in the USA

    I have an old Thompson M1A1 that I got many years ago at a local militaria show. Now I would like to list it for sell here on the e-stand. Will I need to go through a gun shop after the sale? The weapon has an aluminum receiver, but the barrel is not plugged ... will that cause an issue? Any input/advice is greatly appreciated.

    SOLID aluminum receiver = non firearm and not "readily restorable". The barrel being plugged makes no difference.

      Thank you for the comment. I posted this pretty fast yesterday and missed one crucial fact. Actually one of the guns the receiver (dark one on the right) is not solid aluminum and more like machined steel and you can pull the cock back and release it by pulling the trigger. You can release the receiver like you would field strip the gun but it won't separate completely from the trigger mechanism ... I'm not sure why.

        As long as the receiver is not completely functional (chambering and firing ammo) you're okay. If it was a machine gun at one time (the receiver, that is) it must have been rendered deactivated by torch cutting it into three pieces. It would then be welded together into a semblance of a receiver yet it is still inoperative. Oh yes, if it hasn't been torch cut then you are in possession of a machine gun, even if it doesn't work.

          I'm not up on all the laws, I can suggest a few things...

          1) The receiver is the "gun" in the US, the barrel and other parts don't constitute a gun according to the BATF (However be careful going on a plane with gun parts, TSA looks at it another way entirely, but that's another story, and don't ask me how I know)

          2) There were an entire "series" recently published within the past year in "Shotgun News" by a gun named Matthews on building dummy guns. On each article he described how the weapon was modified to meet compliance for a "dummy gun", might be useful if you can scrounge up some of those articles....

          3) When one builds a Semiauto weapon out of a cut receiver (when imported they are considered "scrap" after being cut up), the two caveats are to make sure that a Full Auto bolt cannot be inserted, and to make sure that a FA Fire Control Group cannot be used with the weapon. I would consider at least those two caveats with your weapon. I'm sure others will chime in....
