    OT: Question on Gunbroker sell???

    I have an odd question, maybe one of you guys out there that is a dealer or knows more than me can help out????

    I sold a rifle on gunbroker recently to a buyer that has no feedback. I just heard from him, and he claims that he has already resold the rifle he purchased to another individual (who happens to have an FFL), he wants me to ship the rifle directly to them being that they have purchased the rifle from him, sight unseen.

    So, does this constitute a "straw purchase"? The only thing that seems Kosher is if I get a legit FFL (I verify them all), then I can send to that individual who has an FFL.... Nevertheless it seems odd....I want to make sure I'm doing the right thing.....

    I'm not a lawyer, but I think that if you send the gun to a legit FFL dealer and get a signed copy of his license then it is his responsibility to "dispose" of the firearm in a legal manner that meets all requlations.....meaning if he processes it for the "buyer" of your auction or someone else...it is HIS responsibility to do it properly....you have no further involvement.

      It is up to the FFL to determine if the person is legal to purchase the gun. You are clear of any other responsibilities. You may want to tell the original buyer there will not be any return policy due to his resale. You were dealing with him and not the final buyer.

        I told him that I would sell the rifle to him, expect payment from him only, and ship to the FFL that he provides me. After that he has bought it, and I have shipped to a legal licensed dealer. Just an odd situation that I hadn't ran into before. He was fine with that. My concern was having someone who wanted me to take his payment, and then ship the rifle off to someone entirely different, which I wasn't going to do, even with the fact that it was going to a dealer. It has to be his transaction alone. Thanks for the tips guys, Chris...
