    What exactly are you talking about?. I am guessing it is an MP 40?? More info. is needed such as is it full auto and did someone try to make it a de-act simply by removing the firing pin which won't fly at all with the BATF or is it papered. Please provide a photo and more info. Tom

        This needs to be papered, even if a DEWAT, procede carefully.

        Many of these are still left around that never made the deadline.

        If legal, it's worth a pile.

        Need to know a whole lot more than "burpgun."

          If unaware of papers, its probably not legal and equals jail time. Seriously.

          I always thought or attributed the term "burp guns" to be the cheap mass produced Stens or Grease guns. What are you using for your source???. I am curious as I thought it was a generic term.

            50+ years collecting and researching.

            The "Burp" referred to the sound.

            It was more aptly applied later to the PPSH 41 with a higher rate of fire.

              If the registration papers can't be found, you need to check with the Bureau of Alcohol, Tobacco, Firearms and Explosives ("BATFE") to see if the gun appears in their computerized database of registered machineguns. This database is known as the National Firearms Registration and Transfer Record ("NFRTR").

              Do NOT call your local BATFE field office about this, as they will simply tell you that the gun must be surrendered to BATFE or, worse, they may track you down and send out agents to investigate. You need to be in contact with the BATFE's National Firearms Act Branch ("NFA Branch") in Martinsburg, WV and speak to a qualified person who can access the records and give you a yes or no as to whether this gun appears in the NFRTR.

              If you like, I'll get a friend of mine at NFA Branch to run the gun through the NFRTR. This friend is a confirmed "gun guy" who will do everything legally possible to help preserve historic machineguns. You will need to either send me an e-mail or post the full serial number of the gun as well as identify what make/model it is. Photos of the serial number and make/model markings would be helpful.

                You need to make sure the gun is registered first. If it is, then you are ok! All you need to do is contact a class 3 dealer to sell/transfer the gun to a buyer. I have a very good friend who is a class 3 dealer, so if you need one, just send me a PM, and let me know!

                    You must be mistaken about what you think you might have, I would double check and make no contact with anyone. You cant just say hey I have this MG can you run the serial#??.

                    And do not post any pictures of anything unless you are sure it is legal. Trust no one!

                      Why did you post this?? You have messaging. You are asking that a person post photo's on an open forum of what could be an illegal weapon and probably not papered. And if it is it can still be seized as its most likely not registered to him.

                      10 years in jail and $250,000 fine. And they prosecute with diligence. An amazing request for public consumption. Ignorance is certainly no excuse for the law when this is case.

                        I like what Allen said as it seems common sence. But what Vid says is still jumping about in my mind. It would be awful for this weapon to be destroyed simply because it wasnt registered . Surley there is a way to keep this thing( for as Allen says) historical purposes. Good luck I dont know what I would do.

                          A PM should have been sent, not a request for photo's first of all. Secondly an inspection of the weapon which is pretty easy would be required. And if not registered you could essentially speak to someone about having it taken in a manner where it will not be destroyed such as donating it to a museum. ATF is not gong to do that, they will keep it at best.

                          Worse case scenario, he posts photo's of a live illegal full auto weapon on a public forum and its a warrant. Knock, knock!!

                          You might as well have 8 Kilo's of cocaine in a storage facility. Can we see pictures of you cocaine sir??

                          No, if its functional the possessor probably has an idea where it came from and who had it. From there he can probably make a judgment as to whether that person registered the weapon. If he feels it is not registered, he could go to a pay phone and start dropping coins for West Virginia and ask what the process would be. Seizure is the answer. Donating to a museum is an option, they can take it and paper it to themselves through ATF.

                          But I certainly would not risk picking up my phone or e-mailing some guy off a forum and playing around with an item that will have you in an 8x10 cell if you so much as whisper anything about money or compensation, or go's outside of the strict mandates set by the ATF on how these weapons are to be handled.

                          Never think these guys are your friends, they are not. Nice guys finish last, a nice guy with a machine gun could go to jail, lose his house and mount 200k in legal fees trying to avoid just that.

                            I would check and get the information and turn it over to an attorney and allow him to contact ATF to discuss options. This way there is a concerted effort to comply with the law and backup in the form of a lawyer to dispel any mis-truths or misunderstandings in how this would go down to protect the interests of the party involved in regards to "intent".

                            Either way, unless registered to him he is an "illegal Possessor" and cannot own, possess, transport said weapon under any circumstances.

                            That would be my course of action, may be additional costs but minimal and your arse is covered.

                            If my posts seem as though I distrust law enforcement, it is simply because I do distrust law enforcement, they don't always do the right thing.

                            Don't have to be a brain surgeon to figure that out.

                            Maybe this Allen person is sincere in his offer for assistance, but to request photo's is over the top. Never become complacent with the law.

                            That is my opinion.
