Many people probably don’t know that the Nazi party was a corporation, just like GM or IBM.
The following are pages showing it’s incorporation on 1 December 1933.

These pages rule first that the former registered associations "national socialistic workers association" and "Hitler-youth movement" had to be erased from the register and their capital became capital of the NSDAP as public corporation. It further rules the structure of the NSDAP with regard to its formations and affiliated organizations and their legal status or position.

The NSDAP was a public corporation until 12 December 1942, when Adolf Hitler declared it to be a unique institution subject only to its own regulations and laws.

Jeff, I'm not sure that this is entirely correct. The term "Körperschaft des öffentlichen Rechts" is more a term used to describe an organization such as a political, medical or educational one. The Term "Körperschaft des privaten Rechts" would be used to describe a corporate type (or, as an example, the German GmbH) organzation. The 1942 regulations you have shown appear to create an order that separates the Party and the State which were considered one and the same up to this point. The very first page you have in the first post has the title that headlines the law of securing the State and Party as being one and the same. Perhaps some of our native German speakers could provide more detailed information.

The term "Körperschaft des öffentlichen Rechts" means a corporation under public law (a public corporation). The law shown here and the also shown regulations and regulatory statutes have are titled / related to the law for the security of the unity of the party and state. So the overall goal was not the separation but the unity of these two – party and state.

§ 1 I of the law for the security of the unity of the party and state rules the following:

“After the victory of the nationalsocialistic revolution the national socialistic workers party is the carrier of the german nation-concept and indivisibly bound to the state.”

§ 1 II
“She (the party) is a public corporation. Her articles of corporation are ruled by the leader.”

§ 2
“To ensure the tightest cooperation of the offices of the party and the SA with the public authorities the deputy of the leader and the chief of staff of the SA become members of the Reichs-cabinet.”

The regulation to the law for the security of the unity of the party and state with date of 29th March 1935 ruled under § 4 and 5 that the formations of the party had no own legal personality, while the affiliated organizations could have an own legal personality.

I think this should explain that Jeff was correct here. The party was a public corporation indeed.
