Does look like a captured SVT 40. Here is a picture of one in use by the Germans.

Yes I agree, they were used extensively by the Germans

I used to own a true sniper variant

Difficult to tell from the photo, but looking at the magazine size, and it appears to have a slight curve to it as well. Also, it appears to have a gas system on top of the barrel.

So I would agree it's probably an SVT-38 or STV-40.
