Looks like Spanish Guardia Civil due the hat he is wearing called Tricornio and it is specific for this Police Corps.
Maybe taken in the north of Spain, it's from a German album? I have seen some photos from San Sebastian beach in severak German photo albums.

Guardia Civil made in this time a lot of service in rural area and was normal to them to wear a rifle onstead a handgun.

Beware of your tongue, I have a lot of family members and friends ub the Guardia Civil unfortunately neither are picture inyour photo, but I try to research where I can find this members.........
