Dr. Ley was not the only high-ranking member of the NSDAP Government to wear one version of the shoulder eagle or another instead of the Party brassard -- Dr. Goebbels was another who immediately comes to mind, and there were others as well. But I believe the comment has been made that this was a uniform style that was acceptable when that person was traveling outside of the Reich; when he returned to Grossdeutschland, he would again don the proper armband.
What is further interesting about this photo is that Ley was never a member of the SS -- he was an SA-Obergruppenführer -- and presumably had no claim to wearing the SS shoulder eagle. One wonders whether this pictured eagle might have been gold instead of silver, given the character of this man...?!
