It was not an "On The March" product that was never produced...It is in her possession (20 months now).
The most likely scenario given what's transpired is that she has already sold everything everyone sent to her.

Last time I talked to lowlife, she said that she'd be caught up on her back orders in a couple of months, and then would be starting on mine. In retrospect, I see she told me this a couple of weeks before PayPal's 180 protection period was about to expire.

Well I am still hopeful that I will get my tunic back. I think personal issues as well as volume just overwhelmed the business and it folded but stuff (unfinished uniforms) is just sitting.
Money on the other hand doesn't sit around...gets spent...and if we're lucky debtors can repay creditors back eventually, but only after a plan is in place with the bankruptcy court and the means become available (again).
(it also depends on the bankruptcy chapter...) I just want my pre WW1 uniform back...It is really only worth something after its restored and she was the right person to do so...very experienced. A shame really!
Btw selling other persons items (consigned goods) is theft and I highly doubt that occurred, knowing her.

And yet you don't have your tunic back, do you?

If she does not give it back or respond to you, you should file a police report. Waiting any longer does not improve your situation. It is your property she has no right to keep it or do anything with it beyond give it back to you.

And why that group of French hobbyists had to secure the services of a lawyer who specializes in international fraud.

I never asked for it to be returned to me ...She actually offered to return it in the beginning of the year if I did not want to wait much longer.... but I decided to let her finish it on her schedule as the work is so good. This would have been my 3rd project with her and I have always been a satisfied customer albeit the very long lead times. Now that I know that the company folded I will chase this and demand my property back. Thanks for making me aware of the situation with this thread. I was not alarmed but the communication with the company did stop a while ago...now I know the reason!

Under bankruptcy law, once an individual files, their creditors (us) can no longer legally communicate requests for repayment of debt**. Cute, huh? We'll have to wait til the court appoints a trustee, and then we'll have to give them formal notification of how much this lowlife owes us. Depending on how she files will determine what kind of repayment plan the court approves. So best case scenario, we'll get $10 drops in our buckets of collective debt if we're lucky.

Also, her site is still up.

**I bet she'd filed for bankruptcy right after she ceased communication with her "customers."

                  On the March Fraud

I too have been robbed by Virginia Bergman. I've had a couple of beautiful tunics completed by her over the last four years and had a current outstanding order worth more than $3000 for officers breeches and a couple tunics, not to mention all the original insignia that I sent her for these projects. These orders were more than two years old and Bergman stopped communicating with me by email on July 24, 2017, with assurances that one tunic was complete and ready for shipment. It's been complete radio silence since then. I phoned the lawyer listed in this thread and they confirm Bergman intends to file for bankruptcy but that this has not yet taken place. Otherwise they were less than helpful. Basically I'm screwed and fervently hope Bergman pays for this theft and fraud.

This was more or less about the same time our communications ceased as well.

I would suggest you get in touch with the Sauk County Sheriff's Dept. and let them know what this degenerate thief has been up to. Their number is (608) 356 4895.

                          Phone as well.

There are also two phone numbers that I found associated with Bergman. She apparently lives with her parents and helps manage rental properties.

                          The home number is 608-524-2476,

and the rental number is 608-415-0625.

They never answer, go figure, but I'm sure hearing from those who have lost their hard earned money to Bergman might like to call and leave a voicemail to see if they can get a refund or their orders completed and property returned.

I sent a demand letter along with pictures of my tunic (to jog her memory...its been 21 months already since she received it for restoration), and mailed it to her address in Reedsburg today in an effort to get it back...
Also in the letter a stern warning from me that the Sheriff's department in Saulk County would get notified if it wasn't handled properly...(a consigned good, never her property, needs to get resolved!)

An additional copy of this letter was mailed to the attorney's address (144 4th Avenue, Baraboo, WI 53913) (p) 608-355-0621 (f) 608-329-6324, explaining that the tunic was not her property and not part of the bankruptcy proceedings and that I would want it back ASAP.

The down payment for the restoration can go thru the bankruptcy court...$300, I can kiss that money goodbye but I do want my uniform back!!! Fingers crossed! I will also call those ph numbers and leave messages with the same content! Thanks for the help so far!

The woman is a pathological liar and thief.

First you'll need to file a report w/ your local PD. If you just call the Sauk Country Sheriff's Dept they'll tell you to do that first. Of course cops being cops, they'll do nothing about it, but at least there will be a record of it, for whatever that'll be worth.

Perhaps we should all sign a letter and send it to the WI DA?

And have you received a reply, or just more of her incriminating silence?
