President signs legislation ending Nazi benefit checks

An intriguing subject I was never aware of comes up. Probably not so impacting with so few now and with what little mileage these vet's have left in them.

WASHINGTON — President Barack Obama on Thursday capped a swift and forceful response to an Associated Press investigation by signing into law a measure that bars suspected Nazi war criminals from receiving U.S. Social Security benefits.

In all seriousness though, the Germans funded through their taxes, their respective Social Security benefits. Seems to me that if they are not going to get their Social Security payments, they should at least be entitled to a refund of their Social Security payments. Seems like it may be, perhaps, an unconstitutional taking from the government without just compensation (i.e., violation of the Fifth Amendment).

Unfortunately Walter, the U.S. Supreme Court has ruled that workers have no legally binding contractual rights to their Social Security benefits, and that those benefits can be cut or even eliminated at any time (Fleming v. Nestor (1960)). Further, the court held that Social Security is not an insurance program but simply a "payroll tax" (no refunds) on one side and a welfare program on the other.

To quote the Supreme Court:, “To engraft upon the Social Security system a concept of ‘accrued property rights’ would deprive it of the flexibility and boldness in adjustment to ever changing conditions which it demands.” The Court went on to say, “It is apparent that the non-contractual interest of an employee covered by the [Social Security] Act cannot be soundly analogized to that of the holder of an annuity, whose right to benefits is bottomed on his contractual premium payments.”

Also in 1954, Congress passed a law saying that any person deported from the United States shall lose his Social Security benefits. This law was upheld by the Supreme Court.

Anyway, Social Security is the largest ponzi scheme in history... currently $23 trillion of unfunded liabilities...

Very interesting Jim, thank you. Based on the foregoing, I have no doubt how the government is going to re-trade the deal for most Americans. As the Social Security obligations mature, to the extent that the government cannot print enough money to pay them, they will just cut those payment obligations from those that are deemed to be sufficiently well off. It is, indeed, a Ponzi scheme in every sense of that term.

They will just keep raising the age to receive benefits. Soon, you will have to be over 80 to collect. This means fewer jobs for young people and morepeopke on welfare. One way or the other, dependancy on the government, for income, increases every year.

Back to the individual post, how many Nazi war suspects will this actually affect?

The article states since 1979 it involves 38 people including a V2 rocket scientist, who was likely to have worked for NASA. Not sure how many it impacts today.

I am glad my government is on the ball to stop the fraud and waste regarding my tax dollars.

No, not von Braun as I think he died in 1977.

Von Braun brought quite a few scientists of his V-2 group with him to the US, most likely this is one of them... Von Braun died in 1977, he had cancer.
