    Gorgeous EK1. for sale at Regimentals....

    Hi fellas,

    i was just browsing the Cloth headgear forum, and there was the link to Regimentals in the UK, so i thought id see there stock...and bang on the first page, this is what you get..... ;

                IMHO think some dealers do this intentionally... the leave "bad" items sitting on their sites after they have been notified they are fake in hopes that that some inexperienced collector comes along and scoops it up, sometimes for days - if not longer Pretty pathetic IMHO. If it were me, I'd have the item pulled within minutes of realizing it was fake.

                    Malcom Fisher is as crooked as the day is long. Most of his high end badges are all fake. Somewhere along the way he found the path to the dark side.

                      Something I've always wondered: when you have sellers like this or worse - Snyder - and they consciously try to sell something as original though it is not, is that even legal? I can't but imagine that constitutes fraud or something...

                          It's a very good question. I think the problems would be jurisdiction, and proof. How exactly do you establish when something like an EK1 was made? We all know it's fake, but a judge may not. Also, if the sale is international, that would complicate matters. My guess is, it would be easier to prosecute something like that if the item in question was, say, a $10,000 fake SS uniform, and the sale was local.

                            The international character of many of these sales form, no doubt, a legal obstacle. But if for argument's sake a matter like this would go to court, I take it specialists would testify and their voices weigh in. If someone tries to sell a Rembrandt at Sotheby's and during the auction it would turn out the painting is a fake, and the seller knew this, I believe criminal proceedings could well follow, proceedings during which said specialists would speak for the prosecution.

                            I know the comparison is a bit far fetched, but on the other hand there are several awards, decorations etc. that go for thousands and thousands of dollars, euros and pounds. They merit legal protection against fraud as much as any other product I should think.

                            Any lawyers in the room who can shed light on the matter?

                              I do not think this is the point. Nobody needs to prove anything.
                              What mathers is that the collectng community/experts unanimously consider this cross fake.

                              What remains is that the dealer sells something advertised as an accepted and valued product while it has no value.
                              If the dealer knows this it is fraud.
                              If the judge accepts he did not know, then dealer had no criminal intent but is still responsible for the moneytary loss in the transaction.

                              Dont you worry, with these prices in militaria, sooner or later, some dealers will face charges.
